Introduction

These Terms and Conditions of Use (hereinafter, the "Terms") govern your use of the services offered by Globetrotter Excursions (hereinafter "we", "our" or "the Company") through our website and travel services. By using our services, you agree to these Terms in their entirety. We encourage you to read this document carefully before making any booking or use our services.

Legal Framework

These Terms are governed by the laws of Guatemala and applicable international laws, including but not limited to, the Law of Consumer Protection and User (Decree 006-2003), the Code of Commerce of Guatemala, and the regulations and international tourist applicable.

Use of the Web Site

3.1. You must be at least 18 years old to use our services. Minors can use the website under the supervision of a responsible adult.

3.2. You agree to use our website only for purposes that are legal and in accordance with these Terms.

3.3. It is prohibited to use the website for any illegal activity, fraudulent or violates the rights of third parties.

3.4. We reserve the right to suspend or terminate access to the website of any user who violates these Terms.

Reservations and Payments

4.1. All bookings are subject to availability and confirmation by the Company

4.2. Payments will be made in the currency specified on the reservation. The exchange rates applicable shall be those in force at the time of payment.

4.3. It may require a deposit to confirm the booking. The remaining balance must be paid according to the specific terms of each booking generally no later than 30 days before the start date of the trip.

4.4. We accept payments by credit cards, wire transfers and other methods specified on our web site. All payments are subject to verification.

4.5. Prices are subject to change without notice until full payment and confirm the booking.

Cancellations and Refunds

5.1. The cancellation and refund policies vary depending on the type of service booked. For detailed information on our cancellation and refund policies, please refer to the corresponding section on our web site.

5.2. It is the responsibility of the customer to familiarize yourself with these policies before you make a booking.

5.3. All cancellation requests must be made in writing and will be effective as from the date on which the Company receives them.

5.4. Refunds will not be given for services not used or cancellations during the trip, except in exceptional circumstances at the discretion of the Company.

Chargebacks

6.1. In case of a chargeback, the customer must notify us immediately through the contact email provided on our website.

6.2. We reserve the right to dispute any chargeback unjustified, and submit all required documentation to support the original transaction.

6.3. In the event of a chargeback successful, the client agrees to reimburse the Company for any expense incurred in the dispute the chargeback, including but not limited to, banking fees and administrative costs.

6.4. The Company reserves the right to take legal action in case of chargebacks, fraudulent or unwarranted.

Travel insurance

7.1. We strongly recommend that all guests purchase comprehensive travel insurance that covers cancellations, medical emergencies, evacuation, baggage loss, and other unforeseen events.

7.2. The Company will not be responsible for any loss, damage, injury, disease or death that could have been covered by adequate travel insurance.

7.3. It is the responsibility of the customer to ensure that your insurance policy covers all the activities included in the itinerary.

Limitation of Liability

8.1. The Company shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to, loss of profits, data or use.

8.2. Our maximum liability in any case shall not exceed the total amount paid by the client for the services in question.

8.3. The Company will not be responsible for any loss, damage or inconvenience caused by circumstances beyond our control, including but not limited to, delays or flight cancellations, strikes, natural disasters or acts of terrorism.

8.4. We are not responsible for services provided by third parties, although we've recommended or reserved in your name.

Compensation

You agree to indemnify and hold harmless the Company, its employees, directors, agents and affiliates against any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising from:
(a) Your breach of these Terms.
(b) Your use of our services.
(c) Any violation of any law or the rights of third parties.
(d) Any content or information that you provide.

Force Majeure

We will not be liable for any failure or delay in performing our obligations due to events beyond our reasonable control, including, but not limited to, natural disasters, acts of terrorism, wars, civil disturbances, strikes, pandemics, epidemics, governmental actions, technical failures, or communication, or any other circumstance which may be considered as force majeure.

Confidentiality

11.1. We are committed to maintaining the confidentiality of your personal information in accordance with our Privacy Policy.

11.2. We will not disclose your personal information to third parties, except where necessary to provide the services you request or when required by law.

Prevention of Money Laundering

12.1. We reserve the right to request additional information to verify the identity of clients and the source of funds in compliance with the legislation on the prevention of money laundering.

12.2. We reserve the right to refuse any transaction that we deem to be suspicious or that does not comply with our policies for the prevention of money laundering.

12.3. We will fully cooperate with the competent authorities in any investigation related to money laundering.

Applicable law and Jurisdiction

13.1. These Terms shall be governed and construed in accordance with the laws of Guatemala.

13.2. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Guatemala.

13.3. Notwithstanding the foregoing, we reserve the right to initiate legal proceedings in any jurisdiction that we deem appropriate to protect our interests.

Severability

If any provision of these Terms is held to be invalid, illegal or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

Modifications

15.1. We reserve the right to modify these Terms at any time. The changes will come into force immediately after their publication on our web site.

15.2. It is your responsibility to review these Terms periodically to be aware of any changes.

15.3. Your continued use of our services after any modification constitutes your acceptance of the modified Terms.

Claims

16.1. Any claim must be submitted in writing within 30 days following the completion of the trip.

16.2. We promise to respond to all complaints within 30 working days.

16.3. In case of not reaching an agreement, both parties agree to submit to a process of mediation before commencing any legal action.

17.1. Entire content of our web site, including but not limited to, text, graphics, logos, images and software, is protected by copyright and other intellectual property laws.

17.2. You may not reproduce, distribute, modify or create derivative works from our content without our express written consent.
